30 DAY VEHICLE IMPOUND INFORMATION

                                                      

THE VEHICLE WAS IMPOUNDED FOR ONE OF THE FOLLOWING REASONS:

  • The driving privileges of the person driving the vehicle are suspended or revoked for any reason. (Ariz. Rev. Stat. § 28-3511.A.1.a)
  • The person driving the vehicle has never been issued a license or permit in Arizona or in any other jurisdiction. (Ariz. Rev. Stat. § 28-3511.A.1.b)
  • The person driving the vehicle is subject to a certified ignition interlock device requirement and was operating a vehicle without a functioning certified ignition interlock device. (Ariz. Rev. Stat. § 28-3511.A.1.c)
  • In furtherance of the illegal presence of an alien in the United States and in violation of a criminal offense, the person is transporting or moving or attempting to transport or move an alien in this State in a vehicle if the person knows or recklessly disregards the fact that the alien has come to, has entered or remains in the United Sates in violation of law. (Ariz. Rev. Stat. § 28-3511.A.1.d)
  • The person in concealing, harboring or shielding or attempting to conceal, harbor or shield from detection an alien in this State in a vehicle if the person knows or recklessly disregards the fact that the alien has come to, entered or remains in the United States in violation of law. (Ariz. Rev. Stat. § 28-3511.A.1.e)
  • A vehicle is displayed for sale or for transfer of ownership with a vehicle identification number that has been destroyed, removed, covered, altered or defaced. (Ariz. Rev. Stat. § 28-3511.A.2)
  • The person’s driving privileges are cancelled, suspended or revoked for any reason or they have never been issued a license or permit in Arizona or any other jurisdiction AND the person is not in compliance with the mandatory vehicle insurance requirement AND the driver of the vehicle was involved in an accident that results in either property damage or injury to or death of another person. (Ariz. Rev. Stat. § 28-3511. B)
  • The officer has probable cause to arrest the person driving the vehicle for Underage DUI, (Ariz. Rev. Stat. §4-244) Extreme DUI (Ariz. Rev. Stat. §28-1382) or Aggravated DUI (Ariz. Rev. Stat. §28-1383). (Ariz. Rev. Stat. § 28-3511. C)

ALL POST STORAGE HEARINGS AND VEHICLE RELEASES ARE CONDUCTED BY APPOINTMENT ONLY

MONDAY THROUGH THURSDAY (EXCLUDING HOLIDAYS)

The owner, owner’s spouse, lien holder, repossession agent or other party with a financial interest in the vehicle may request a post storage hearing within ten (10) days from the date of the Vehicle Impoundment Notice for the purpose of any vehicle release. (Ariz. Rev. Stat. § 28-3514) The hearing will be scheduled within five (5) business days, excluding weekends and holidays from the date requested. (Ariz. Rev. Stat. § 28-3514) Arriving late for a scheduled hearing will be considered a failure to appear and the request for release will be denied. State statute affords the opportunity for a SINGLE POST STORAGE HEARING. (Ariz. Rev. Stat. § 28-3514) If you FAIL TO APPEAR to a scheduled hearing or release meeting the Department will have met its requirement to provide you with a post storage hearing. (Ariz. Rev. Stat. § 28-3514)

OWNER INFORMAITON:

The vehicle MAY be eligible for an early release IF one of the following exemptions applies: 

  • There is evidence that the vehicle was stolen and reported stolen prior to being impounded. (Ariz. Rev. Stat. § 28-3512.A.1)
  • The vehicle is subject to bailment. (Ariz. Rev. Stat. § 28-3512.A.2)
  • The owner’s driving privileges have been reinstated. (Ariz. Rev. Stat. § 28-3512.A.3)
  • The vehicle is registered as a rental vehicle. (Ariz. Rev. Stat. § 28-3512.A.4)
  • The registered owner or owner’s spouse was not the driver at the time of impoundment. (Ariz. Rev. Stat. § 28-3512.A.5)
  • The vehicle is equipped with a certified ignition interlock device. (Ariz. Rev. Stat. § 28-3512.B.4)
  • The vehicle is subject to foreclosure or repossession. (Ariz. Rev. Stat. § 28-3512.D)

OWNER RELEASE REQUIREMENTS:

  1. Present a valid Driver’s License.
  2. Present current vehicle Registration.
  3. Provide proof of valid vehicle Insurance.
  4. Pay Administrative Fee of $150 to the Avondale Police Department (Money Order or Cashier’s Check only).
  5. Pay Towing and Storage Fees to the Towing Company.

*Additional forms may be required in some cases.

If you are the spouse of the registered owner, but not listed on the registration please fill out the Legal Spouse Affidavit to obtain the release of the vehicle.

If the owner is unable to attend the hearing, he/she may designate a Limited Power of Attorney to someone with a valid drivers license, who was NOT the driver at the time of impound to obtain the release of the vehicle.  

LIEN HOLDER INFORMATION:

The vehicle MAY be eligible for an early release to a person, other than the owner IF all of the following conditions are met:

  • The person is a motor vehicle dealer, bank, credit union or acceptance corporation or any other licensed financial institution legally operating in this state or is another person who is not the owner and who holds a security interest in the vehicle. (Ariz. Rev. Stat. § 28-3512.D.1.b)
  • The person pays all the towing and storage charges related to the impoundment of the vehicle and any administrative charges established. (Ariz. Rev. Stat. § 28-3512.D.2)
  • The person presents foreclosure documents or an affidavit of repossession of the vehicle. (Ariz. Rev. Stat. § 28-3512.D.3)
  • The person requesting the release of the vehicle was not the person driving the vehicle at the time of impoundment. (Ariz. Rev. Stat. § 28-3512.D.4)

LIEN HOLDER RELEASE REQUIREMENTS:

  1. Present a valid Driver’s License.
  2. Present Identification to prove association with the business (business card).
  3. Present Authorization to act as Recovery Agent (authorization letter on company letterhead).
  4. A Notarized Repossession Affidavit from Motor Vehicle Division –or– a Writ of Replevin from any court authorizing the repossession of this specific vehicle.
  5. A completed Avondale Police Department Lien Holder Harmless Agreement. 
  6. Copy of the Registration, Title or Contract.
  7. Proof of vehicle Insurance.
  8. Current valid registration and insurance requirement may be waived with proof of “Hook and Tow” Agreement or by using a Dealer Plate Registration and Company Insurance Coverage.
  9. Pay Administrative Fee of $150 to the Avondale Police Department (Money Order or Cashier’s Check only).
  10. Pay Towing and Storage Fees to the Towing Company.

*Additional forms may be required in some cases.

Please note that NEW OWNERS and NEW LIEN HOLDERS ARE NOT ELIGIBLE FOR EARLY RELEASE. You must have been identified as an owner or lien holder on the department’s record at the time of impoundment.
